These Terms of Service ("Terms") govern your access to and use of Kiomi, an artificial intelligence platform offering image generation, conversational chat, unfiltered research, and web application building tools (collectively, the "Service"), operated by Verve ("Verve", "we", "us", or "our").
By creating an account, clicking "I agree," accessing the Service through any interface (web, app, or API), or otherwise using Kiomi in any manner, you agree to be bound by these Terms and our Privacy Policy (available at /privacy-policy). This agreement applies to you whether or not you read these Terms on the Service website, within the app, or through any third-party distribution of this document, and your continued use of the Service constitutes ongoing acceptance of the current version of these Terms.
If you do not agree to these Terms, you must not access or use the Service.
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction, if higher) to create an account. If you are between 13 and the age of majority in your jurisdiction (typically 18), you may use the Service only with the knowledge, supervision, and consent of a parent or legal guardian, who agrees to be bound by these Terms on your behalf.
You represent and warrant that: (a) you have the legal capacity to enter into these Terms; (b) all information you provide is accurate and current; and (c) your use of the Service does not violate any applicable law or regulation in your jurisdiction. In some jurisdictions, local law may restrict access to uncensored AI services — you are solely responsible for ensuring your access is lawful where you live.
Kiomi provides the following features, which may evolve over time:
We may add, modify, suspend, or discontinue any part of the Service at any time, with or without notice. Because Kiomi is designed to be uncensored, outputs may be blunt, controversial, mature, or offensive. You choose to use Kiomi at your own discretion and assume responsibility for engaging with its outputs.
Content generated by Kiomi — including text, images, code, and research summaries — is produced by machine learning models and may be inaccurate, incomplete, misleading, hallucinated, or unlawful in context. AI-generated output is not professional advice (legal, medical, financial, safety-related, or otherwise) and must never be relied upon as such. You must independently verify any information before acting on it.
Kiomi's uncensored design means we do not guarantee that outputs are safe, appropriate, or free of objectionable material. You acknowledge that exposure to such material is an inherent and accepted characteristic of the Service.
Kiomi is uncensored with respect to lawful, adult-oriented, mature, controversial, and creative content. However, the following are absolutely prohibited, and their generation, upload, sharing, or distribution through the Service is a material breach of these Terms:
Interpretation note: This policy defines the outer legal boundary, not a morality filter. Lawful adult content, strong language, political opinions, fictional violence, mature creative writing, security research, and controversial topics are all permitted. We do not proactively monitor content beyond what is technically and legally required, but we will act on credible reports of the violations listed above.
Your inputs and generated outputs ("User Content") belong to you, to the maximum extent permitted by law and to the extent you hold rights in them. By using the Service, you grant Verve a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, and transmit your User Content solely as necessary to operate, maintain, and improve the Service (for example, processing prompts through our AI models).
You represent and warrant that you own or have the necessary rights to your inputs (including any images, text, or code you upload) and that your inputs do not violate these Terms or any third party's rights.
Because AI models learn and generate probabilistically, outputs may resemble existing works or be produced for other users as well. We do not claim ownership of outputs, and we make no representation that outputs are unique, non-infringing, or eligible for copyright protection — the copyright status of purely AI-generated content varies by jurisdiction and is your responsibility to assess.
Kiomi relies on third-party infrastructure and AI model providers to deliver the Service. Your prompts, conversations, and generation requests may be transmitted to and processed by these third parties. Their handling of data is described in our Privacy Policy. We are not responsible for the acts, omissions, availability, or policies of third-party providers, and third-party model behavior may change without notice.
You are responsible for safeguarding your account credentials and for all activity under your account. Notify us immediately of any unauthorized use. We may suspend or terminate accounts that violate these Terms, that create legal risk for us or third parties, or that engage in systematic abuse of the Service. You may delete your account at any time, after which we will handle your data as described in the Privacy Policy.
The Service is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue the Service (or any feature) at any time. If we make material changes to these Terms, we will update the "Last Updated" date and, where reasonably possible, notify users through the Service or by email; continued use after changes take effect constitutes acceptance.
You may stop using the Service at any time. We may terminate or suspend your access immediately, without notice, for conduct that we reasonably believe violates these Terms or applicable law.
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AND UNINTERRUPTED AVAILABILITY. VERVE DOES NOT WARRANT THAT THE SERVICE OR ITS OUTPUTS WILL MEET YOUR REQUIREMENTS, BE ERROR-FREE, OR BE SUITABLE FOR ANY PARTICULAR USE.
TO THE FULLEST EXTENT PERMITTED BY LAW, VERVE AND ITS OPERATORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR ANY AI-GENERATED CONTENT.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) USD $100. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN SUCH CASES, THESE LIMITS APPLY TO THE FULLEST EXTENT PERMITTED.
You agree to indemnify, defend, and hold harmless Verve and its operators from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from: (a) your use or misuse of the Service; (b) your User Content; (c) your violation of these Terms or applicable law; or (d) your infringement of any third party's rights.
The Service is currently provided free of charge. We may introduce paid plans, credits, or subscriptions in the future. If we do, the applicable pricing, billing, refund, and auto-renewal terms will be presented to you before any charge and incorporated into these Terms, and we will never charge you without your explicit consent.
These Terms are governed by the laws of Bangladesh, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service shall first be addressed by contacting us at verveofficial@atomicmail.io; we will attempt good-faith resolution within 30 days. Where mandatory local consumer law grants you the right to bring claims in your local courts, that right is unaffected.
If any provision of these Terms is held unenforceable, it will be modified to the minimum extent necessary, and the remaining provisions stay in force. Our failure to enforce any right is not a waiver of it. These Terms (together with the Privacy Policy) constitute the entire agreement between you and Verve regarding the Service. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or asset sale.
